These Terms govern your use of the website and travel concierge services provided by FlyFortyOne LLC, operating as FORTYONE (“we,” “us,” or “our”).

1. Acceptance of Terms

By using our website or purchasing our services, you agree to these Terms and any booking-specific conditions presented before payment.

If you do not agree, please do not use our services.

You must be at least 18 years old to purchase services and have authority to act for any travelers included in your request.

2. Our Services

FORTYONE is an independent travel concierge. We help customers find available flight options and arrange bookings through airlines and third-party booking fulfillment providers.

We are not an airline and do not operate flights. References to American Airlines, Alaska Airlines, or other airlines identify travel options and do not imply an official partnership or endorsement.

The operating airline’s conditions of carriage and the terms applicable to your ticket also govern your travel. They do not remove any obligations we owe you under applicable law.

3. Booking Requests and Availability

Submitting a request does not guarantee availability, pricing, a seat assignment, or an issued ticket.

We will present available options and confirm the itinerary, cabin for each flight segment, total price, and applicable restrictions before you authorize the booking.

If your requested flight is unavailable, we may offer alternatives. We will obtain your approval before booking a different itinerary.

Round trips may be issued as two separate one-way reservations with separate confirmation numbers and ticket conditions.

4. Traveler Information

You are responsible for providing accurate traveler information, including legal names matching travel identification, dates of birth, contact information, and requested travel dates.

Review your itinerary and traveler details promptly and notify us of any errors. Corrections may be subject to airline restrictions, availability, and additional charges.

If you book for another person, you confirm that you have permission to provide their information and arrange their travel.

Travelers are responsible for meeting applicable identification, check-in, boarding, and travel-document requirements.

5. Pricing and Payment

Prices are quoted in U.S. dollars unless stated otherwise. Advertised prices apply only to eligible itineraries and are subject to availability.

We will disclose the total price, including mandatory taxes and fees and any FORTYONE service charges, before payment. Optional purchases, such as additional baggage or paid seat selections, may cost extra.

By submitting payment, you authorize the amount shown at checkout and confirm that you are authorized to use the payment method provided.

Your personal airline points, miles, or rewards balances cannot be used to pay for bookings through FORTYONE.

Any eligibility to earn airline rewards or receive loyalty benefits depends on the ticket and airline rules. We do not guarantee those benefits.

6. Ticket Issuance and Confirmation

A payment receipt or booking request acknowledgment is not confirmation that an airline ticket has been issued.

We will disclose the expected ticketing timeframe before payment and provide airline confirmation details when ticketing is complete.

If we cannot issue your approved itinerary, we will notify you and offer available alternatives. If you decline those alternatives, we will refund the amount paid to us for the unfulfilled booking, including associated FORTYONE service charges.

7. Changes, Cancellations, and Refunds

Contact support@flyfortyone.com to request a change or cancellation.

Voluntary changes and cancellations depend on the ticket conditions disclosed before purchase. Additional fares, airline charges, or separately disclosed service fees may apply. Some tickets may be nonrefundable or nontransferable.

We will explain available options and costs before processing a requested change.

If an airline cancels or significantly changes your flight, your refund and rebooking rights are determined by applicable law and the circumstances of your booking. Where a refund is required, these Terms do not restrict that right or require you to accept a credit instead.

Any separately charged FORTYONE service fee and its refund conditions will be disclosed before payment. Such conditions remain subject to applicable law.

Do not assume that an airline’s 24-hour cancellation policy applies to a booking made through FORTYONE. Ask us to confirm the cancellation terms before purchasing.

Nothing in these Terms waives your statutory rights or your right to raise a legitimate payment dispute.

8. Airline Operations and Travel Disruptions

Airlines control flight operations, schedules, aircraft, boarding, baggage handling, and operational seat changes.

Seat requests are subject to availability and airline reassignment. Cabin amenities, baggage allowances, and lounge access vary by airline, ticket, route, and aircraft.

We will assist with booking-related issues, but we cannot guarantee that an airline will operate on time or that a particular replacement flight will be available.

This section does not exclude our responsibility for our own services or any refund or other obligation imposed by law.

9. Membership Waitlist

Joining the FORTYONE membership waitlist does not create a paid membership, guarantee admission, or reserve a particular price or benefit.

Membership pricing, benefits, and any subscription terms will be provided separately before enrollment. Joining the waitlist does not authorize us to charge you.

10. SMS / Mobile Messaging Program

Program name: FORTYONE / FlyFortyOne LLC.

Message purpose: Depending on your consent, messages may include booking updates, itinerary notifications, concierge communications, account notifications, membership announcements, and promotional offers.

Consent: By separately opting in, you agree to receive the types of messages described in the opt-in disclosure at the mobile number you provide. Messages may be sent using automated technology.

Marketing consent is voluntary and is not a condition of purchase. Agreeing to these Terms alone does not enroll you in SMS marketing.

Message frequency: Message frequency varies.

Cost: Message and data rates may apply.

Opt-out: Reply STOP to unsubscribe. We may send one final message confirming your opt-out. Recurring messages will stop unless you provide new consent.

Carrier disclaimer: Carriers are not liable for delayed or undelivered messages.

Privacy: We handle your information in accordance with our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. SMS opt-in data and consent will not be sold, rented, or transferred. Messaging service providers may process this information solely as necessary to deliver messages on our behalf.

Please notify us if you change or give up the mobile number enrolled in the program.

11. User Conduct

You agree not to:

Provide false traveler, identity, or payment information.

Use payment methods or personal information without authorization.

Send spam or misuse our forms and communication channels.

Attempt to access accounts, systems, or information without authorization.

Interfere with the security or operation of our website.

Use our services for unlawful or fraudulent purposes.

12. Intellectual Property

Website content, branding, graphics, and materials are owned by FlyFortyOne LLC or used with permission and are protected by applicable intellectual property laws.

You may not reproduce, distribute, or commercially exploit our materials without permission, except as permitted by law.

Airline names, logos, and other third-party trademarks remain the property of their respective owners.

13. Website Availability and Liability

We aim to provide accurate website information, but errors and service interruptions may occur. We may correct website errors and will obtain your approval before proceeding with a booking at a corrected price.

To the extent permitted by law, we are not liable for indirect or consequential losses arising from use of our website or services.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including applicable consumer protections, required refunds, or liability for fraud, gross negligence, or willful misconduct.

14. Privacy

Our Privacy Policy explains how we collect, use, retain, and share personal information, including information provided to airlines and booking fulfillment providers to arrange your travel.

15. Governing Law

These Terms are governed by the laws of [State of formation or counsel-approved governing state] and applicable federal law, without overriding mandatory consumer protections that apply to you.

16. Changes to These Terms

We may update these Terms and will publish the revised version with an updated date.

Changes will apply prospectively. They will not retroactively remove rights or alter agreed pricing and cancellation conditions for an existing booking without your agreement, except where required by law.
